Bonvitel Terms of Service

Effective: the date Bonvitel begins providing service · Last updated: November 6, 2026

1. Who We Are

Bonvitel ("Bonvitel," "we," "us," "our") is a communications platform provided by Bonvitel LLC, a Texas limited liability company, with its principal place of business at 6160 Warren Parkway, Suite 100, Frisco, TX 75034. Bonvitel offers two services:

  • Offering A — Business Communications Platform: a phone system, mobile eSIM lines, and AI-assisted communications tools for businesses with 1–500 employees.
  • Offering B — Agent Infrastructure Platform: API-accessible VoIP/SIP numbers, voice, and messaging infrastructure for developers and AI agents.

These Terms of Service ("Terms") govern your access to and use of both offerings (collectively, the "Service"). By creating an account, you agree to these Terms.

2. Eligibility and Account Verification

You must be at least 18 years old and able to form a binding contract to use the Service. Business accounts must provide accurate legal name, address, and contact information.

  • Accounts with more than 10 users (Offering A) must verify their Employer Identification Number (EIN) against IRS/state records and provide a business email domain.
  • All accounts, both offerings, undergo identity and billing verification, including Address Verification System (AVS), CVV, and 3-D Secure checks, and sanctions (OFAC) screening, before service is provisioned.
  • Prepaid and virtual cards are not accepted for account verification.
  • We reserve the right to decline or terminate any account that fails verification or appears on a sanctions list.

3. No Free Tier; Payment Terms

There is no free tier or free trial on either offering. A verified payment card is required before any line, number, or service is provisioned, because Bonvitel incurs a real third-party carrier cost the moment a line is activated or a message or call is sent.

  • Billing: Service is billed on a usage basis as incurred — a base subscription or platform fee plus metered usage (SMS, voice minutes, AI-voice minutes, or API usage) — not as a prepaid flat month.
  • Month-to-month: There is no minimum contract term. You may cancel at any time.
  • Taxes and regulatory fees: Applicable USF contributions, E911 fees, and state/local taxes are itemized and passed through at cost.
  • Accounts over 50 users (Offering A) or Volume/Enterprise (Offering B) may be invoiced and are subject to credit review and a signed order form.

4. Cancellation and Fees

You may cancel your account at any time with no penalty for the usage-based charges already incurred. In addition:

  • eSIM discard fee (Offering A only): $10 per active eSIM line at the time of cancellation, covering the wholesale carrier provisioning cost already incurred by Bonvitel for that line.
  • Early-termination fee (both offerings): $15 if your account is canceled within 30 days of signup. This fee does not apply after the first 30 days.

These fees reflect costs Bonvitel has already incurred on your behalf and are not penalties for cancellation itself.

5. Numbers, Porting, and 911 Service

  • Number porting: We honor number porting into and out of Bonvitel at no charge for porting in. A porting status and estimated timeline will be made available to you.
  • Port-out security: A PIN or passcode, verified against the number itself, is required before any number may be ported away from Bonvitel, to protect against unauthorized port-out fraud.
  • E911: Every number capable of placing calls to standard telephone numbers is provisioned with E911 service and a dispatchable location, as required by the Kari's Law and RAY BAUM's Act. You are responsible for keeping your registered service address current. Numbers that are SMS-only or inbound-call-only may not include E911 service; this will be disclosed at the time the number is provisioned.

6. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations may result in immediate suspension without prior notice.

7. Messaging Compliance

  • Outbound messaging campaigns are registered under A2P 10DLC (or the applicable campaign-registry standard) and subject to TCPA consent requirements.
  • Any recipient who replies STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT is permanently and immediately suppressed from further messages on that number, across every channel, on your account. This suppression cannot be overridden and is logged for compliance purposes. Only a reply of START or UNSTOP re-enables messaging to that number.
  • Bulk and campaign content, including AI-generated voice broadcasts, is screened before it is sent. Content flagged as election-suppression language, impersonation of a public official or government agency, or synthetic-voice impersonation of a real person will be held for review rather than delivered.

8. AI Features

Offering A's AI receptionist and Offering B's agent infrastructure are provided with built-in scope-of-authority limits: the AI cannot quote unauthorized pricing or provide medical or legal advice, and it is designed to escalate callers expressing crisis or distress to a human rather than complete an automated transaction. You remain responsible for configuring your AI agent(s) within the bounds of applicable law and these Terms.

9. Data, CPNI, and Privacy

Our collection and use of your information, including Customer Proprietary Network Information (CPNI), is described in our Privacy Policy, incorporated into these Terms by reference. You may request export or deletion of your account data as described there.

10. HIPAA Mode

A HIPAA-compliant mode with a signed Business Associate Agreement (BAA) is available on request for accounts in healthcare-adjacent verticals. Standard accounts are not HIPAA compliant unless this mode is enabled.

11. Service Availability

We target high availability but do not guarantee uninterrupted service. Uptime service level agreements, where applicable, are described in your plan's specific terms.

12. Suspension and Termination

We may suspend or terminate your account immediately, without prior notice, for violation of these Terms, the Acceptable Use Policy, suspected fraud, robocall or spam activity, sanctions-list matches, or non-payment. You remain responsible for charges incurred prior to termination.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BONVITEL'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO BONVITEL IN THE THREE MONTHS PRECEDING THE CLAIM. BONVITEL IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to active account holders. Continued use of the Service after changes take effect constitutes acceptance.
